§ 1. General provisions

  1. The privacy policy and the cookies use policy for the website (hereinafter: the “Policy”) was developed and adopted by
    SEMPRE Farby Sp. z o. o. 43-301 Bielsko-Biała, ul. Gen. J. Kustronia 60 NIP /Tax ID No./ 5471995321 Poland.
  2. The terms used in this Policy shall have the following meanings:
    1. Website: website;
    2. User: an entity using the publicly available Website;
    3. Owner: SEMPRE Farby Sp. z o. o. 43-301 Bielsko-Biała, ul. Gen. J. Kustronia 60 NIP /Tax ID No./ 5471995321 Poland
    4. Cookies: text files sent by the Website and saved on the User’s end device, used by the User when browsing websites. The files contain information necessary for the proper operation of the Website. Cookies usually contain the name of the website domain from which they come, their storage time on the end device and the number;
  3. The purpose of this Policy is in particular:
    1. providing Users with information regarding the use of Cookies on the Website, as required by legal regulations, including the Telecommunications Law;
    2. providing Users with privacy protection to the extent corresponding to the standards and requirements specified in applicable legal provisions.
  4. The Owner limits the collection and use of information about Users to the minimum necessary to provide services to them.
  5. In order to gain full access through the Website to the content and services offered by the Owner, it is advisable to accept the terms and conditions of this Policy.
  6. The following legal provisions, among others, are applicable:
    1. Act of 16 July 2004, Telecommunications Law (Dz. U. /Journal of Laws/ 2017.1907, i.e. as amended);
    2. Act of 18 July 2002 on the provision of electronic services (Dz. U. /Journal of Laws/ 2017.1219, i.e. as amended);
    3. Regulation of the European Parliament and the Council (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) O.J. L 119 of 04.05.2016) together with Polish personal data protection regulations.

§ 2. Protection of privacy and personal data

  1. Users’ data shall be processed by the Owner in accordance with the law. The Users’ personal data obtained by the Owner shall be processed on the basis of the consent granted by the User or the occurrence of another premise authorizing the processing of data in accordance with the provisions, in particular the Regulation.
  2. The Owner takes special care to protect the interests of the data subjects, and in particular ensures that the data is:
    1. processed in accordance with the law, reliably and transparently for Customers and other data subjects;
    2. collected for specific, explicit and legitimate purposes and not further processed in a manner inconsistent with these purposes;
    3. adequate, relevant and limited to what is necessary for the purposes for which they are processed;
    4. correct and, if necessary, updated;
    5. kept in a form which permits identification of the data subject for no longer than is necessary for the purposes for which the data is processed;
    6. processed in a manner ensuring adequate security of personal data, including protection against unauthorized or unlawful processing and accidental loss, destruction or damage, by means of appropriate technical or organizational measures,
  3. The Owner shall use appropriate technical and organizational measures to ensure protection of the personal data being processed that are appropriate to the nature, scope, context and purposes of processing as well as the risk of violating the rights or freedoms of natural persons.
  4. The Owner shall strive to systematically modernize the IT, technical and organizational measures to protect this data, in particular, the Owner shall provide updates of IT security measures to assure protection against viruses, unauthorized access and other threats arising from the operation of the IT system and telecommunications networks.
  5. Each User who made their data available to the Owner in any way shall be provided access to their data and the possibility to exercise other rights as data subjects by the Owner, in accordance with applicable law, including:
    1. the right to withdraw consent to the processing of personal data;
    2. the right to be informed about their personal data;
    3. the right to control the processing of data, including their supplementing, updating, rectifying, deleting;
    4. the right to object to processing or to limit processing;
    5. the right to complain to the supervisory authority and use other legal means to protect their rights.
  6. The Owner may process personal data in an automated manner, including profiling, on the terms resulting from the Regulation. In this case, the purpose of the Owner’s actions are marketing purposes or the need to personalize messages sent to Users (including tailoring the information to the User’s needs or expectations). The User has the right to object to such processing of their data – this objection may be expressed by sending a message to the Owner’s address at:
  7. A person with access to personal data processes the data only on the basis of the Owner’s authorization or under a personal data processing agreement and only at the Owner’s request.

§ 3. Cookies

  1. Cookies identify the User, which allows the content of the website they use to be adapted to their needs. By remembering their preferences, it allows adjusting the content addressed to them, including advertisements. The Owner uses Cookies to guarantee an appropriate standard of Website convenience, and the collected data is used only internally in the company to optimize activities.
  2. Cookies are used for the following purposes:
    1. adjusting the content of the Website to the User’s preferences;
    2. optimizing the use of the Website, in particular by recognizing the User’s end device,
    3. creating statistics,
    4. maintaining the User’s session,
    5. providing the User with advertising content.
  3. Cookies may be placed on the Website User’s end device.
  4. The collected data is used to monitor and check how Users use the Website in order to improve the operation of the Website, ensuring more effective and trouble-free navigation.
  5. It should be noted that in some cases, which are beyond the control of the Owner, the software installed by the User on the end device, used for browsing websites (e.g. a web browser) places the default Cookies on the User’s end device. Users may change Cookie settings at any time. These settings can be changed in particular in such a way as to block the automatic handling of cookies in the web browser settings or to inform every time they are placed on the Website User’s end device. Detailed information in this regard is available in the settings and instructions of the software (web browser).
  6. The User may, at any time, disable or restore the option of collecting cookies by changing the settings in the web browser.
  7. Changing the settings constitutes an objection which may cause difficulties in using the Website in the future. Disabling the option of accepting Cookies completely does not mean that the content posted on the Website will not be possible to be viewed, except if such access requires logging in.
  8. Failure to change the settings shall mean that the data will be stored in the User’s end device (using the Website will automatically place Cookies on the User’s end device).
  9. The data stored on the User’s end device shall not cause any configuration changes on the User’s end device or the software installed on this device.
  10. Information on Cookies also applies to other similar technologies used on the Website.

§ 4. Final provisions

  1. This Policy was adopted under the Owner’s order and comes into force on 08.09.2016. The content of the Policy may be changed in the same manner.
  2. Any deviations from the Policy must be introduced in writing to be valid.
  3. The law applicable to this Policy shall be the law of the Republic of Poland.
  4. In matters not regulated in the Policy, the relevant provisions of law shall apply.
